Supreme Court’s decision on disaster fund

The Supreme Court today dismissed an appeal by a NGO looking for move of commitments in PM CARES Fund to National Disaster Response Fund (NDRF).

The NDRF is a legal reserve made under Section 46 of the Disaster Management Act, 2005. The court held that individual and associations are allowed to add to NDRF and there is no denial on the equivalent. In any case, PM CARES is a different store set up as an open magnanimous trust and no bearing can be given to move assets from that to NDRF, a three-judge seat headed by Justice Ashok Bhushan dominated. While discarding the request, the court said that there is no requirement for new national calamity help plan.
